PREAMBLE

These General Terms and Conditions of Sale (GTCS) apply to all services offered by La Villa Haussmann and govern the contractual relationship between SNC La Villa Haussmann (the “Professional”) and its clients (the “Consumer”). The introductory article of the French Consumer Code defines these two terms (“Professional” and “Consumer”).

These conditions and their appendices may include the following documents:

• Appendices to which they refer by hypertext link (e.g. price lists);
• Internal regulations and safety instructions that may apply when the service is provided (e.g. swimming pool internal regulations);
• Any quotations.

The GTCS constitute the Contract between the Customer and La Villa Haussmann, notwithstanding the means of reservation (direct, by telephone or e-mail, or via a platform or service provider).

All prices in these GTCS are inclusive of all taxes (except tourist tax) and service (where applicable).

When the Customer makes a reservation at La Villa Haussmann, he contracts with SNC La Villa Haussmann, whose head office is at 2431 route de Cagnes (06140 VENCE). The company is registered with the RCS under SIREN number 832 422 943, and its intracommunity VAT number is FR 58 832 422 943.

The services provided by SNC La Villa Haussmann will be performed in or from its premises, La Villa Haussman, located at 132 boulevard Haussmann, 75008 Paris.

Under article L214-1 of the French Consumer Code, all sums paid in advance by the Customer should be considered prepayments, not deposits. This payment corresponds to the time of Contract conclusion.

Customers are reminded that due to the nature of the services offered and in the application of article L221-28 12 of the French Consumer Code, they cannot exercise their right of withdrawal for any of the services provided hereafter.

SERVICES AND CONTACT DETAILS

La Villa Haussmann offers two main types of services:

• A 4-star luxury hotel service and seminar room rentals;
• A catering service consisting of restaurant, open for lunch, and its lounge bar, called N3.

RESERVATIONS PROCEDURES AND POLICIES

Check-in is from 15:00, and check-out before 12:00 (noon). In the event of early check-in, late check-in or late check-out, the Customer must inform the Front Desk as soon as possible. Staff will do their utmost to accommodate without this constituting an obligation on the part of La Villa Haussmann.

Late check-out may give rise to a surcharge of one additional night. In the event of an early departure, La Villa Haussmann will charge 100% of the remaining stay.

To confirm a booking made under non-cancellable and non-refundable terms, a deposit of 100% of the total cost of the stay will be required. For bookings made under other conditions, confirmation will be subject to a pre-authorization equivalent to the cost of one night’s stay.

Any outstanding balance (balance of the booking and/or ancillary services used) must be paid at the latest at check-out.

All cancellations must be made in writing by the Customer. La Villa Haussmann will refund deposits only if cancellation is made at least 24 hours before arrival date.

RATES

Room rates are per night. Breakfast is not included.

However, the following are included: WI-FI, access to the wellness facilities (swimming pool, fitness room and hammam).

Rates may fluctuate depending on the Hotel’s occupancy rate, the size of the facilities or the room’s location. The room categories are as follows:

• Classic : € 200 to € 1 500
• Superior : € 220 to €1 650
• Deluxe : € 240 to € 1 800
• Junior Suite : € 300 to € 2 550
• Suite : € 400 to € 3 750

These rates are quoted as an indication —the rate specified at the time of booking prevailing.

A tourist tax (base 2022) of €2,88 per person (adult) per overnight stay (over 18 yo).

Rates for the main services in addition to the room reservation:

Complimentary swimming pool, fitness room and hammam accesses.
Extra bed: €65 per night.

As this service may not be available at the last minute, Customers must inform La Villa Haussmann of their wish for this supplement at the latest booking time.

If the Customer fails to do so, La Villa Haussmann cannot be held liable for any negative consequences (cancellation, prejudice, etc.).

Pet: €40 per night.

There will be a €6 service charge per person for in-room breakfast.

Concierge supplements (in-room flowers, decoration, or wine/champagne bottle, etc.): bespoke services requiring agreement with the Hotel.

RIGHT OF RETENTION

Please note that in case the Customer fails to pay for any Hotel service, La Villa Haussmann reserves the right to hold onto all of their property until the outstanding balance is cleared. This right is exercised at the sole discretion of La Villa Haussmann in compliance with articles 1948, 1951, and 1952 of the French Civil Code.

RESTAURANT RESERVATION: TERMS AND RATES

Opening Hours (restaurant): Monday to Friday from 12:00 (noon) to 14:30

Opening Hours (lounge bar): Every day from 7:00 to 23:00.

For services not specified or for which the price is not stated in these GTCS (e.g. seminar facility reservation or privatization), please get in touch with La Villa Haussmann for a tailormade offer.

DAMAGE AND THEFT

Any damage or theft committed on La Villa Haussmann premises will be billed at a flat rate of €250.

If the amount of damage or theft exceeds the fixed amount, La Villa Haussmann reserves the right to invoice the actual amount of the cost incurred.

A commercial general liability policy with a reputable French insurance company covers La Villa Haussmann.

LOST AND FOUND ITEMS

Items found by La Villa Haussmann staff will be kept in a secured location for three (3) years as per law, provided that their size permits.

At the Customer’s first request, these objects will be returned. However, La Villa Haussmann reserves the right to request any document that verifies ownership of the object or guarantees its return to its rightful owner (invoice, identity document of the person mandated to recover the object, etc.).

Where applicable, any shipping and insurance costs shall be borne entirely by the Customer.

MEDIATION

Should you have any complaints, do not hesitate to contact our Guest Service. La Villa Haussmann is at your service (reception@lavillahaussmann.fr).

If, within 60 days of sending your complaint to the above address, you consider that the action taken in response to your complaint has not been satisfactory, you may refer the matter to the Tourism and Travel Ombudsman, accessible via this link: www.mtv.travel.

You can contact the mediator within 12 months of sending your complaint.
